NOTICE OF PRE-APPLICATION CONFERENCE TO CONSIDER PRE-APPLICATION INTERVENOR FUNDING REQUESTS AND TO INITIATE THE STIPULATIONS PROCESS

Lighthouse Wind LLC (Lighthouse), a subsidiary of Apex Clean Energy Holdings LLC (Apex), intends to file an application for a Certificate of Environmental Compatibility and Public Need (CEPCN), pursuant to Article 10 of the Public Service Law, for construction of a major electric generating facility. Lighthouse plans to construct a wind energy facility (Project) in the Town of Somerset, Niagara County, New York, and the Town of Yates, Orleans County, New York.
The proposed Project Site is situated on approximately 12 miles of Lake Ontario shoreline and extends approximately 3 to 4 miles south of Lake Ontario. Lighthouse anticipates that the Project will consist of up to 71 wind turbines, but states that the design and layout of the Project, including all turbine locations and the location and dimensions of alternate Project facilities, is not final and will be informed by a number of factors, including environmental studies, wildlife studies, electrical studies, land leasing, cultural assessments, and public input.
On November 23, 2015, Lighthouse filed a Preliminary Scoping Statement (PSS). The preliminary scoping phase of this proceeding will determine the nature and scope of the studies Lighthouse must undertake to develop the information that must be included in Lighthouse’s formal application for a CEPCN. In general, such studies will identify and evaluate the potential impacts of a project on the environment, public health, and other public interest factors.
TAKE NOTICE that a pre-application conference in this proceeding will be held on the 21st day of January, 2016, before Administrative Law Judges David R. Van Ort and Sean Mullany, of the Department of Public Service, and Richard A. Sherman, of the Department of Environmental Conservation. The pre-application conference will begin at 3:00 p.m. at the Barker Volunteer Fire Department Hall, 1660 Quaker Road, Barker, New York 14012. The conference has two primary purposes. First, to enable the Judges to ask questions, and to possibly make contemporaneous rulings, on previously-filed requests for intervenor funds. Second, at the conference the Judges will explain and initiate the stipulations process.
It is expected that Lighthouse, persons and parties that have previously submitted requests for pre-application intervenor funds, and persons or parties interested in pursuing stipulations will attend and participate in the conference. As stated in the Notice Extending Deadlines that was issued on December 16, 2015, comments on the PSS and requests for preapplication intervenor funding are both due on January 12, 2016.
